Smiths & Tailors ("we," "us," "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the rights you have over it. By using smithsandtailors.com (the "Platform"), you agree to the practices described here.

1. Information We Collect

Information You Give Us

  • Account information: Name, email address, password, designer handle, and other details you provide when registering or applying.
  • Profile information: Bio, portfolio samples, reels, credits, skills, software, rates, availability, union status, location, and any other content you add to your profile.
  • Communications: Messages, applications, support requests, and other correspondence with us.
  • Payment information: When you subscribe to a paid tier, payment details are collected and processed by Stripe. We do not store full credit card numbers on our servers.

Information We Collect Automatically

  • Usage data: Pages viewed, links clicked, search terms, time spent on the Platform, and similar activity.
  • Device and connection data: IP address, browser type, operating system, device identifiers, and referring URLs.
  • Cookies and similar technologies: Small files stored on your device that help us recognize you, remember preferences, and analyze usage. See Section 6 for details.

Information from Third Parties

  • Authentication: We use Memberstack to manage user accounts and authentication.
  • Newsletter: If you subscribe to The Motion Brief, your email is processed by Beehiiv.
  • Analytics: We may use analytics services to understand how the Platform is used.

2. How We Use Your Information

We use the information we collect to:

  • Operate the Platform and provide its core features.
  • Create and manage your Account.
  • Display Designer profiles to Producers and facilitate introductions.
  • Process payments and manage subscriptions.
  • Send transactional emails such as account confirmations, password resets, and service announcements.
  • Send The Motion Brief and other newsletters or marketing emails, only if you have opted in. You may unsubscribe at any time.
  • Improve the Platform, develop new features, and analyze usage patterns.
  • Promote Smiths & Tailors and showcase Designer work in our marketing materials, including promotional advertising on the website, in accordance with the licensing terms in our Terms and Conditions.
  • Respond to support requests and resolve disputes.
  • Comply with legal obligations and enforce our Terms.
  • Detect and prevent fraud, abuse, and security incidents.

3. How We Share Your Information

We do not sell your personal information. We share it only as described below.

  • With other users: Designer profiles are visible to other users of the Platform. Producer subscribers can see Designer contact information, including email. Designers should not include personal information in their profiles that they do not want visible to Producers.
  • With service providers: We work with third parties who help us operate the Platform, including Stripe (payments), Memberstack (authentication), Webflow (hosting), Google Cloud (infrastructure), Mux (video hosting), and Beehiiv (newsletter). These providers only access information as needed to perform their services and are bound by confidentiality obligations.
  • For legal reasons: We may disclose information when required by law, court order, or government request, or when we believe disclosure is necessary to protect our rights, the safety of our users, or the integrity of the Platform.
  • In a business transfer: If Smiths & Tailors is acquired, merged, or sells assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your information.

4. Your Rights and Choices

Depending on your location, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Update or correct inaccurate information through your Account settings or by contacting us.
  • Deletion: Request deletion of your Account and personal information, subject to legal retention requirements.
  • Marketing opt-out: Unsubscribe from marketing emails using the link in any email or by contacting us. Transactional emails related to your Account will continue.
  • Cookie controls: Manage cookies through your browser settings. Disabling cookies may affect Platform functionality.

5. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • The right to correct inaccurate personal information.
  • The right to opt out of the sale or sharing of personal information. Smiths & Tailors does not sell personal information.
  • The right to non-discrimination for exercising your privacy rights.

6. Cookies and Tracking

We use cookies and similar technologies for:

  • Essential functions: Keeping you logged in, remembering your preferences, and enabling core Platform features.
  • Analytics: Understanding how users interact with the Platform so we can improve it.
  • Authentication: Working with Memberstack to manage your session.

You can control cookies through your browser settings. Most browsers allow you to refuse cookies or alert you when cookies are being sent.

7. Data Security

We use reasonable technical and organizational measures to protect your personal information, including encryption, access controls, and secure infrastructure. No system is perfectly secure, however, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you as required by law.

8. Data Retention

We keep your personal information for as long as your Account is active or as needed to provide the Platform. After Account closure, we may retain certain information for legal, tax, fraud prevention, or business record purposes. We will delete or anonymize information when it is no longer needed.

9. AI and Automated Data Use

Smiths & Tailors does not use Designer Content, Producer information, or any user data to train artificial intelligence or machine learning models. We prohibit third parties from doing so as well. This prohibition is reinforced in our Terms and Conditions, robots.txt file, and HTML metadata.

10. International Users

Smiths & Tailors is operated from the United States. If you access the Platform from outside the US, your information will be transferred to and processed in the United States. By using the Platform, you consent to this transfer.

11. Children's Privacy

The Platform is not intended for anyone under 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will delete it.

12. Third-Party Links

The Platform may link to third-party websites, including Designer portfolios on external sites, IMDB, LinkedIn, Vimeo, and others. We are not responsible for the privacy practices of those sites. Review their policies before sharing personal information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be announced on the Platform or by email at least seven days before they take effect. The "Effective Date" at the top of this Policy indicates when it was last updated.
